R&M Bindery LLC — Refund & Claims Policy

This Refund & Claims Policy is provided for informational and convenience purposes only and is expressly subject to and governed by the R&M Bindery Terms of Service (“TOS”).

In the event of any conflict between this Policy and the TOS, the TOS shall control in all respects.

1. No General Right to Refund

R&M Bindery provides custom, service-based work performed on Client-supplied materials.

Accordingly:

  • All services are non-refundable once work has commenced
  • Refunds are not guaranteed
  • Any credit, rework, or adjustment is governed solely by the TOS

2. Cancellations

2.1 Prior to Production

R&M Bindery may, at its sole discretion, permit cancellation prior to production.

However:

  • Scheduling, setup, handling, and vendor coordination may begin immediately upon approval
  • Client remains responsible for all work performed and costs incurred

2.2 After Work Has Begun

Once any work has commenced, including setup, handling, or vendor coordination:

  • All deposits are non-refundable
  • Client is responsible for all costs incurred, which may equal up to the full Order value
  • Cancellation does not relieve payment obligations

3. Exclusive Remedy

As set forth in the TOS, the Client's sole and exclusive remedy for any valid claim is:

  • Re-performance (rework) of the affected service portion, OR
  • A proportional credit for the affected service portion

At R&M Bindery's sole discretion.

The following are NOT available remedies:

  • Full refunds (except where required by law)
  • Reprints or replacement of Client materials
  • Payment for downstream production, mailing, or distribution costs
  • Compensation for delays, missed deadlines, or business losses
  • Refunds based on dissatisfaction where specifications were met

4. Refund Eligibility

Refunds or credits will only be considered if:

  • The issue is directly and solely caused by R&M Bindery, AND
  • The claim strictly complies with the TOS (including inspection and notice requirements)

Any approved credit or refund:

  • Is limited to the amount paid for the affected service portion only
  • Will not exceed the liability limits set forth in the TOS

5. Client Responsibility

No refunds, credits, or rework will be provided for issues arising from:

  • Client-supplied materials (including defects, damage, or incompatibility)
  • File errors, artwork issues, incorrect specifications, or imposition errors
  • Failure to request or approve proofs
  • Printing or design defects originating prior to finishing
  • Normal mechanical tolerances and commercially accepted industry variances
  • Shipping, freight, carrier handling, or third-party logistics
  • USPS or mailing-related handling or delays
  • Delays or conditions outside R&M Bindery's control
  • Subjective dissatisfaction where specifications were met

Post-Production / Environmental Conditions

No refunds, credits, or rework will be provided for:

  • Environmental, storage, handling, or transportation conditions occurring before, during, or after delivery
  • Exposure to heat, cold, humidity, pressure, improper packaging, stacking, or transit environments
  • Any degradation, failure, or change in finished goods after completion of services

Including, without limitation:

  • glue or adhesive failure
  • delamination
  • warping
  • binding failure due to heat or storage conditions
  • material distortion or breakdown

Client assumes all risk of such conditions following completion of services and transfer of risk of loss.

6. Claims Process

All claims must strictly comply with the TOS.

6.1 Inspection Requirement

Client must inspect promptly upon delivery or availability.

Failure to inspect constitutes acceptance of the work.

6.2 Claim Deadline

Claims must be submitted within the timeframes required by the TOS.

Late claims are permanently waived.

6.3 Required Documentation

Claims must include:

  • Job / Invoice / Estimate reference
  • Detailed written description
  • Photographic evidence
  • Physical samples

Failure to provide sufficient documentation may result in denial.

6.4 Preservation Requirement

Client must preserve all allegedly defective materials.

No alteration, mailing, resale, or disposal may occur prior to R&M Bindery LLC's inspection.

Failure to preserve materials voids the claim.

7. Chargebacks & Payment Disputes

Initiating a chargeback, reversal, or payment dispute without first complying with the claims process:

  • Constitutes a material breach of contract
  • Voids eligibility for any refund, credit, or remedy
  • Makes Client responsible for all related costs, fees, and legal expenses

8. Refund Processing (If Applicable)

If a credit or refund is approved:

  • It will be issued at R&M Bindery's discretion
  • May be issued as a credit instead of a cash refund
  • Will not include shipping, postage, or third-party costs
  • Will not exceed the applicable liability limits in the TOS

9. Limitation of Liability

All remedies are subject to the Limitation of Liability provisions in the TOS.

To the fullest extent permitted by law:

  • Liability is limited to the amount paid for the affected service
  • No liability for indirect, incidental, or consequential damages

10. No Modification of Terms

This Policy:

  • Does not modify or override the Terms of Service
  • Does not create additional rights or remedies
  • Does not waive any protections available to R&M Bindery
